TERMS AND CONDITIONS OF BOOKING

1. The Contract

1.1. These Terms and Conditions constitute a binding legal contract between Wanderlust Tours ("the Company", "we", "us") and the Lead Passenger ("you") who makes the booking. 1.2. By making a booking, you verify that you have the authority to accept these terms on behalf of your entire party. 1.3. This contract is governed by Scottish Law. Any disputes arising from this contract shall be subject to the exclusive jurisdiction of the Scottish Courts. 1.4. Definition of Service: Unless expressly stated otherwise, our tours are "Day Tours" lasting fewer than 24 hours and do not include overnight accommodation.

2. Booking and Payment

2.1. Immediate Payment: To confirm a booking, payment in full (100%) is required at the time of booking. 2.2. Confirmation: A contract is formed only when we have received full payment and have issued a booking confirmation via email. We reserve the right to decline any booking at our discretion before this point. 2.3. Pricing: Prices are valid at the time of booking. Future price changes will not affect confirmed bookings.

3. Cancellation by the Customer

3.1. Non-Refundable Tickets: All bookings are sold as non-refundable tickets. 3.2. Statutory Exemption: You acknowledge that under Regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory right to cancel (the 14-day cooling-off period) does not apply to contracts for the transport of passengers or leisure activities provided on a specific date. 3.3. No Refunds: Consequently, if you cancel your booking for any reason (including, but not limited to: change of mind, medical issues, travel connection delays, or weather concerns), no refund will be issued. 3.4. Right to Transfer (Substitution): If you are unable to attend, you may transfer your ticket to another person up to 24 hours before departure, provided you notify us in writing (email) with the new passenger's name and contact details. There is no administrative fee for this service. 3.5. Travel Insurance: We strongly recommend that you purchase comprehensive travel insurance that includes "Cancellation Cover" to protect yourself financially against unforeseen circumstances that may prevent you from traveling.

4. Cancellation or Alteration by the Company

4.1. Operational Cancellation: We reserve the right to cancel a tour due to unforeseen operational issues, mechanical failure, or if the minimum number of passengers required to operate the service is not met. 4.2. Refund Entitlement: If we cancel your tour, you will be entitled to a full refund of the ticket price. Alternatively, you may choose to transfer your booking to a future date. 4.3. Force Majeure: If we are forced to cancel due to events beyond our control ("Force Majeure"), such as extreme weather warnings (Red/Amber alerts), road closures, civil strife, or "Acts of God," we will offer a full refund or a transfer to a future date. 4.4. Limitation of Liability: Our liability for cancellation is limited strictly to the cost of the ticket paid. We are not liable for any consequential losses, such as third-party accommodation, travel costs, or connections.

5. Passenger Conduct and Safety

5.1. PSV Regulations: The driver is responsible for the safety of the vehicle and passengers under UK Public Service Vehicle (PSV) regulations. Their instructions must be followed at all times. 5.2. Alcohol Policy: Strictly no alcohol is permitted on board the vehicle. We reserve the right to refuse carriage to any person who appears to be under the influence of alcohol or drugs. 5.3. Seatbelts: Passengers are required by UK law to wear seatbelts at all times while the vehicle is in motion. 5.4. Right to Remove: We reserve the right to terminate the contract and remove any passenger from the tour whose behavior is abusive, threatening, or endangers the safety or comfort of others. In such cases, no refund will be given, and the passenger is responsible for their own return travel.

6. Departure and Timings

6.1. Departure Time: Passengers must be at the designated pickup point at least 15 minutes before the scheduled departure time. 6.2. Missed Departure: The vehicle will depart promptly. If you are not present at the departure time, this will be treated as a "No Show." The bus will not wait, and no refund will be issued. 6.3. Itinerary Changes: We aim to follow the advertised itinerary. However, we reserve the right to alter the route or itinerary due to road conditions, weather, or site closures. Such alterations do not entitle you to a refund unless the tour is fundamentally changed.

7. Liability and Personal Property

7.1. Negligence: Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, as required by Section 65 of the Consumer Rights Act 2015. 7.2. Personal Property: Passengers are responsible for their own personal property. We accept no liability for loss or damage to luggage, cameras, or personal items left on the vehicle, except where such loss is caused by our negligence. 7.3. Third-Party Suppliers: Where the tour includes entry to visitor attractions, ferry crossings, or third-party venues, we act only as an agent. Your contract for that specific element is with the supplier, and their terms and conditions apply.

8. Data Protection (GDPR)

8.1. We will process your personal data in accordance with the Data Protection Act 2018. We will only use your data to administer your booking and will not share it with third parties unless required by law or for the safety of the tour.
